CONDITIONS D’UTILISATION DE LA PLATEFORME TEHTRIS ACADEMY                                                          

Tout accès à la Plateforme TEHTRIS Academy et/ou toute recherche effectuée sur ladite Plateforme et/ou toute utilisation de ladite Plateforme et/ou tout téléchargement d’une partie du contenu de ladite Plateforme par l’Utilisateur vaut acceptation des présentes conditions d’utilisation (ci- après les « Conditions d’Utilisation »). Nous vous remercions d’en prendre connaissance attentivement avant tout accès aux pages contenues dans ce site. 

1. Hébergement du site 

Le Site est édité par : TEHTRI-Security, SAS au capital de 121 284 euros, immatriculée au RCS de Paris 521 474 445, dont le siège social se situe au 13-15 rue Taitbout – 75009 Paris, ci-après dénommé TEHTRIS. 

2. Objet 

La Plateforme TEHTRIS Academy (ci-après dénommée « Plateforme ») a pour objet de proposer à ses utilisateurs (ci-après dénommé(s) «Utilisateur(s)») des modules de formation en ligne (e-learning). 

3. Accès à la Plateforme TEHTRIS Academy 

L’accès à la Plateforme est réalisé selon les modalités communiquées par TEHTRIS. 

4. Propriété intellectuelle 

Les supports disponibles sur la Plateforme TEHTRIS Academy sous quelques formes que ce soit demeureront la propriété pleine et entière de TEHTRIS et ne devront en aucun cas être mis à disposition de tiers. Lesdits supports ne peuvent être utilisés qu’à des fins internes de formations. Le droit d’utilisation des supports n’emporte aucun transfert de droit de propriété intellectuelle. A ce titre, l’Utilisateur de la Plateforme TEHTRIS Academy s’engage à ne pas reproduire, modifier, exploiter les supports et/ou les utiliser à des fins autres que la formation interne. 

Les présentes Conditions d’Utilisation ne confèrent à l’Utilisateur aucun droit de propriété sur la Plateforme. La mise à disposition temporaire de la Plateforme, ne saurait être analysée comme la cession d’un quelconque droit de propriété intellectuelle au bénéfice de l’Utilisateur, au sens du Code français de la propriété intellectuelle. 

5. Responsabilité 

L’Utilisateur est seul responsable de toutes les actions qu’il entreprend au titre de l’utilisation de la Plateforme et ne doit pas agir illégalement dans le cadre de cette utilisation.
 La Plateforme TEHTRIS Academy est fournie en l’état, sans garantie d’aucune sorte, ni expresse, ni tacite autre que celle prévue par la loi en vigueur et notamment sans garantie que le contenu répond aux besoins de l’Utilisateur ni que le contenu soit à jour.

TEHTRIS s’efforce de fournir un contenu fiable, toutefois TEHTRIS ne peut garantir que la Plateforme TEHTRIS Academy soit exempte d’inexactitudes, traduction, omissions, et/ou virus. TEHTRIS se réserve à tout moment et sans préavis le droit d’apporter des améliorations et/ou des modifications au contenu de la Plateforme 

La Plateforme n’étend pas, ni ne modifie en aucune façon la garantie qui pourrait s’appliquer au titre des relations contractuelles existantes entre l’Utilisateur et TEHTRIS.                  

TEHTRIS ne pourra être tenu responsable des dommages indirects et imprévisibles résultant de l’usage de la Plateforme notamment et sans limitation, tout préjudice financier ou commercial, perte de programme ou de données du système d’information ou autre de l’Utilisateur, même si TEHTRIS a eu connaissance de la possibilité de survenance de tels dommages. 

6. Confidentialité 

Sont notamment considérées comme des Informations Confidentielles : les contenus de la Plateforme TEHTRIS Academy, la documentation afférant à ladite Plateforme et, de façon générale, toutes informations qui ne sont pas du domaine public et toute information désignée par écrit comme confidentielle par TEHTRIS. 

L’Utilisateur s’oblige à garder strictement confidentielle toute information qui a été portée à sa connaissance dans le cadre de l’utilisation de la Plateforme TEHTRIS Academy. 

7. Traitement de données à caractère personnel 

Conformément aux dispositions de la loi 78-17 du 6 janvier 1978 modifiée, l’Utilisateur dispose d’un droit d’accès, de modification et de suppression des informations collectées par TEHTRIS. Pour exercer ce droit, il reviendra à l’Utilisateur d’envoyer un message à l’adresse suivante : privacy(@)tehtris.com 

L’Utilisateur peut retrouver l’ensemble des mentions relatives à l’utilisation de ses données personnelles sur le lien Politique de Confidentialité disponible sur le site Internet de TEHTRIS. 

8. Mise à jour des présentes Conditions d’Utilisation 

TEHTRIS se réserve le droit de modifier et mettre à jour à tout moment les règles d’accès et d’utilisation de la Plateforme ainsi que les présentes Conditions d’Utilisation. Ces modifications et mises à jour s’imposent aux Utilisateurs qui doivent en conséquence se référer régulièrement à cette rubrique pour vérifier les Conditions d’Utilisation en vigueur. Les Utilisateurs s’engagent à prendre connaissance de l’intégralité de toute nouvelle version des Conditions d’Utilisation de la Plateforme et à les respecter. 

9. Droit applicable et règlement des litiges

By entering the TEHTRIS Academy Platform and/or conducting a search on the Platform and/or using the Platform and/or downloading any content of the Platform, the User accepts these uses terms (hereinafter the "Terms of Use"). Please read them carefully before accessing the pages contained in this site. 

1. Site hosting
The Site is published by : TEHTRI-Security, a simplified joint-stock company (French SAS) with a shared capital of EUR 121,284. Its head office is located at 13-15 rue TAITBOUT, 75009, PARIS, France, and is listed in Paris’ Trade and Companies Register under SIRET Code number 521 474 445, hereinafter referred to as TEHTRIS. 

2. Purpose 

The TEHTRIS Academy Platform (hereinafter referred to as "Platform") is to offer its users (hereinafter referred to as "User(s)") online training modules (e-learning). 

3. TEHTRIS Academy Platform access 

The Platform access shall be made in accordance with the terms and conditions communicated by TEHTRIS. 

4. Ownership 

The materials available on the TEHTRIS Academy Platform in any form whatsoever shall remain the full and complete property of TEHTRIS and shall not be made available to third parties under any circumstances. Such materials may only be used for internal training purposes. The User’s rights to use the materials shall not entail any transfer of intellectual property rights. As such, TEHTRIS Academy Platform Users undertakes not to reproduce, modify, exploit the materials and/or use them for purposes other than internal training. 

These Uses Terms do not grant to the User any ownership rights to the Platform. The Platform temporary provision shall not be construed as the transfer of any intellectual property right to the User, as defined in the French Intellectual Property Code. 

5. Responsibility 

The User is the sole responsible for all actions it takes in connection with the Platform use and shall not act illegally in connection with such use. The TEHTRIS Academy Platform is provided on an "as is" basis, without warranty of any kind, either express or implied, other than as provided by applicable law, and in particular without any warranty that the content meets the User's needs or that the content is current. 

TEHTRIS strives to provide reliable content, however TEHTRIS cannot guarantee that the TEHTRIS Academy Platform is free of inaccuracies, translations, omissions, and/or viruses. TEHTRIS reserves the right to make improvements and/or changes to the content of the Platform at any time and without notice 

The Platform does not extend or modify in any way the warranty that may apply under the existing contractual relationship between the User and TEHTRIS.
 TEHTRIS shall not be liable for any indirect and unpredictable damage resulting from the Platform's use, including, without limitation, any financial or commercial loss, loss of programs or data in the User's information system or otherwise, even if TEHTRIS has been made aware that such damage may occur.                     

6. Confidentiality 

In particular, the contents of the TEHTRIS Academy Platform, the documentation relating to the Platform and, in general, any information that is not in the public domain and any information designated in writing as confidential by TEHTRIS shall be deemed to be Confidential Information. The User undertakes to keep strictly confidential any information that has come to its knowledge in the course of using the TEHTRIS Academy Platform 

7. Personnal Data Processing 

In accordance with the amended French Data Protection Act 78-17 of January 6th 1978, the User has the right to access, modify and delete information collected by TEHTRIS. To exercise this right, the User should send a message to the following address: privacy(@)tehtris.com 

The User may find all the notices relating to the personal data use on the Privacy Policy link available on the TEHTRIS website. 

8. Uses Terms Upadating 

TEHTRIS reserves the right to modify and update the rules for access to and use of the Platform and these Use Terms at any time. Such changes and updates are binding on Users, who must therefore refer to this section regularly to check the current Use Terms. Users agree to read all new versions of the Use Terms Platform and to comply with them. 

9. Applicable law and settlement of disputes 

These Use Terms as well as the Platform and its contents are governed and interpreted according to the French law provisions.
 If an amicable solution cannot be found within a reasonable period of time, any disputes relating to these Uses Terms and the Platform use shall be submitted to the French courts exclusive jurisdiction.

With the cases exception where an agreement expressly derogates from this, disputes between persons having the status of a merchant will be subject to the Commercial Court of Bordeaux.
